Failure to follow these terms of service

Your failure to abide by these Terms and Conditions may result in services or products not being delivered or not being delivered to a high standard. Failure to follow these Terms and Conditions may make the customer ineligible for any monetary refunds.

Hire setup

Space requirements

To facilitate photo booth setup, you are required to provide a clear area of flat, level floor space, of approximately 3 meters by 3 meters, and a room height of at least 2.4 meters. The setup area must be flat and level — uneven, sloped or soft ground (such as loose gravel, sand or muddy grass) may prevent safe setup of the photo booth and any associated equipment such as the marquee. If the area provided is not suitable, Shutter Share reserves the right to relocate equipment or, where no suitable area is available, to decline setup. It is also recommended that you pick somewhere guests will naturally visit, but where the bright flash won't disturb your main event. Shutter Share will not be held liable for any event disturbances (e.g. flashing lights) during the normal operation of the photo booth. If you do not indicate an area for the photo booth or hire equipment, Shutter Share staff will find an area we deem appropriate for setup. We do not accept responsibility if an undesirable location for equipment set-up is selected. The customer must not move hired equipment once Shutter Share staff have set this up, as this puts the equipment and others at risk.

Power requirements

You are required to provide Shutter Share with access to an uninterrupted standard Australian 240V power outlet within 5 meters of the photo booth.

Weather protection

The photo booth and all hire equipment must be sheltered from rain, wind and direct weather exposure at all times. For indoor venues, this is typically satisfied by the venue itself.

For outdoor events, you must provide an appropriate waterproof shelter with sufficient room for the photo booth (minimum 3 m × 3 m covered area). Shutter Share offers an Outdoor Marquee add-on that satisfies this requirement. If you choose to provide your own shelter, it must be waterproof, securely anchored and large enough to fully protect all equipment from the elements.

Shutter Share reserves the right to refuse to set up the photo booth outdoors — or to pack down early — if weather conditions on the day are deemed dangerous or pose an unacceptable risk to equipment, staff or guests (including but not limited to high winds, electrical storms, heavy rain or extreme heat). In such cases, the Weather and emergency cancellation clause applies.

You are still required to provide power for outdoor events (see Power requirements).

Venue access

You must provide Shutter Share staff with access to the venue for 1 hour before and 1 hour after the event, for setup and teardown.

If there are difficult or specific access requirements at the event, you must inform us ahead of time to allow us to accommodate them.

If you hire a printer, Shutter Share staff will require periodic access to the event and venue to restock paper and ink. The frequency of this access will be determined by Shutter Share and depends on the number of guests at the event.

Shutter Share will make reasonable efforts to access the requested venue at the requested time, according to your instructions. If, for any reason Shutter Share cannot gain access to the venue, and contacting you does not provide a resolution, setup will not occur, and you will still be liable for the cost of the hire.

Parking

Nearby parking for 1 vehicle must be provided to facilitate setup, teardown and any other equipment servicing to deliver equipment hire. Shutter Share will pay any relevant parking fees involved in providing hire equipment up to $30 for the whole event. If parking costs more than $30 for the provision of services for the whole event, the customer will be sent a receipt and must reimburse Shutter Share for the parking price difference.

Internet connection

Our photo booths have a cellular internet connection. However, if the venue does not have an acceptable 4G signal (see https://www.telstra.com.au/coverage-networks/our-coverage for Telstra 4G coverage guidance - not a guarantee of coverage), and if you would like photos at the event, your options are:

  • The venue provides a WiFi internet SSID and password to Shutter Share for free.
  • The venue provides a wired Ethernet internet connection for free.

To ensure a stable internet connection, we recommend that you obtain any relevant internet connection options the venue provides ahead of time and provide them to us as soon as you can.

Shutter Share does not claim any responsibility and will not be held liable if an internet connection can't be established. If an internet connection cannot be established, the photo booth will still function, but AI features, Glam Filters and photo sharing will not be available. In the event of no internet connection, the photos and videos will be provided to the client in a digital gallery following the event within one week.

Guest behaviour

It is your responsibility to promote the hired equipment, accessories, and any add-ons to guests at your event. We are not liable for underutilised addons (such as a guestbook) and similar, and will not be required to provide you with a refund.

Guests may not stand on any objects while using the photo booth. They may only stand on the ground. No piggy-backs allowed.

Guests under the age of 18 must have consent from and be supervised by a parent or guardian. Children under the age of 12 may not operate the photo booth controls.

In the event of a wilful damage/vandalism event, we require your and your guests' assistance in identifying relevant persons and may require you or your guests to assist with police or insurance inquiries.

Only Shutter Share authorised staff may adjust photo booth setup and set down, technology settings and adjust any associated hardware (e.g. printers, photo booth, camera, flash, power supply, antennas). If you require technical assistance at the event, please contact Shutter Share promptly.

Damage, loss and cleaning

You are responsible for loss of, or damage to, our equipment and hired items caused by you, your guests, your venue, or anyone under your control (excluding fair wear and tear). If loss or damage occurs, you agree to pay the reasonable costs we incur to repair or replace the affected items, and any reasonable cleaning costs required to restore items to a hygienic and usable condition.

This does not apply to reasonable accidental damage to complimentary props (where provided); we do not charge for accidental prop damage. However, we may charge for loss, theft, wilful damage, or excessive damage beyond reasonable wear.

Where repair is not practical, replacement cost may be based on the retail replacement price (or nearest equivalent) and reasonable shipping costs. We will provide supporting information on request (such as invoices, repair quotes, or purchase receipts where available).

The security deposit is not a damage bond unless we state otherwise in writing. If there are damage or loss costs, we may invoice you and payment is due in accordance with the invoice terms.

Marketing and personal information

By contacting Shutter Share (for example, via our enquiry form), you consent to us contacting you about your enquiry and booking (including service-related updates). We will only send marketing communications where you have requested them or where permitted by law, and you can opt out at any time.

Newsletter

Our contact and quote forms include an optional newsletter opt-in. If you opt in, your email address will be shared with our email newsletter provider, Beehiiv, to send you photo booth tips, event inspiration, and exclusive offers. You can unsubscribe at any time using the link in any newsletter email. See our Privacy Policy and the Beehiiv Privacy Policy for more information.

Guest data collection

Email addresses and phone numbers are also collected when guests send emails and SMS to themselves from the photo booth. If requested, the photo booth can be configured to collect further information from guests. Once you receive this information, you must treat it responsibly and lawfully.

Photo and video marketing

Photos, videos and similar outputs produced through the use of Shutter Share services (e.g. photo booth) may be used for promotion and marketing purposes by Shutter Share, including but not limited to the website and Instagram, where consent has been obtained. Where available, the photo booth software will provide guests the opportunity to opt in or opt out of marketing use at the time of usage, and we will respect those choices. If you (as the event organiser) do not wish content from your event to be used for marketing, you must inform us at or before the time of booking. Shutter Share will not use images that are deemed unsuitable or inappropriate for promotion and marketing purposes and will endeavour not to use any content that we consider may be personally damaging to any person(s).

Your personal data

We treat your personal details as private information, and we do not sell or share your personal data with third parties, except when required by law. First names/ organisation names and event dates may be used to publicly identify events on our website for the purposes of accessing your password-protected images. For any concerns, questions, or to delete your information, you may contact Shutter Share at any time. Our collection and handling of personal information is described in our Privacy Policy.

Following the event, the customer will be provided with access to the photos and videos from the event in a digital gallery. This is hosted on Booth Events, which is subject to their privacy policy. Access to the customer's photos will be available from Shutter Share for 3 months. It is your responsibility to ensure you make a copy before the gallery is removed from Shutter Share's services after this period. Photos and videos will also be stored on the photo booth itself during your event. In the unlikely occurrence of theft, damage or catastrophic failure of the photo booth equipment that stores images and videos, Shutter Share will not be held liable for loss or damage in relation to the lost images and videos.

Bookings and payments

Who can book

You must be at least 18 years of age to make a booking with Shutter Share. If you are booking on behalf of an organisation, school, or another person, you represent that you have the authority to do so and to bind that entity or person to these Terms.

If you are organising an event where minors will be present (such as a 16th birthday party, school event, or similar), you are responsible for obtaining all necessary parental or guardian consents for those minors to participate in the photo booth activities and for the collection and use of their images and personal information as described in these Terms and our Privacy Policy.

Bookings and quotes

Quotes are estimates based on the information you provide and may change if your event requirements change (for example, event times, location, add-ons, access requirements, or travel). A booking is only confirmed once we have accepted it and you have paid any required security deposit (unless we confirm otherwise in writing).

Shutter Share does not take responsibility in the event that the customer does not fill out the booking form accurately (e.g. filling in the wrong date, time or event location). The customer will not be eligible for any monetary refunds.

Payments

Payments may be required to confirm a booking (including security deposits, remaining balances, overtime fees, and other charges described in these Terms).

All prices are in Australian dollars (AUD). If GST is to be charged on an invoice it will be included in the price.

If we offer online payments, they are processed by Stripe. We may also send quotes and/or invoices via Stripe (for example, via a Stripe-hosted payment link). Shutter Share does not store your full card details; Stripe handles payment card data on its systems. We may receive confirmation of payment and limited payment information (such as the payment status, amount, and last 4 digits of a card) to manage your booking.

Your use of Stripe is also subject to Stripe's terms and privacy policy.

Security deposit

If required, the security deposit secures your event date and may be applied toward your total booking fee. Unless we state otherwise in writing, the security deposit is not a damage bond. Security deposit refundability is set out in the Cancellation Policy below.

Promotions and discount codes

From time to time we may offer promotions and discount codes.

  • Eligibility depends on the code. The eligibility criteria (if any) will be specified with the promotion or code.
  • Redemption depends on the code. How and when a code can be redeemed will be specified with the promotion or code.
  • No stacking. Discount codes cannot be combined with other offers or discount codes unless we explicitly state otherwise.
  • Quote it early. Discount codes must be quoted at the time of your initial enquiry or during initial discussions. Codes provided after this may not be accepted.
  • No exclusions. Unless a particular promotion or code says otherwise, there are no exclusions.
  • We may change promotions. We may change, suspend, or withdraw promotions and discount codes at any time. Existing quotes and bookings given using the discounts will be honoured.
  • We may refuse or cancel. We reserve the right to refuse or cancel any discount code (and, where we reasonably believe a code is being misused, to cancel a booking).

Cancellations and changes

Cancellation policy

More than 21 days before the event

You may cancel the event more than 21 days before the event and we will refund any amount paid, including your security deposit.

21 days to 7 days before the event

You must pay your full remaining balance in full 21 days or more before the event. If you fail to pay your full remaining balance 21 days or more before the event, we will cancel your booking and retain your security deposit.

If you cancel the hire booking between 7 and 21 days before the event date, we will not refund your security deposit, but we will refund the remaining balance you paid.

7 days or less before the event

If you cancel your event within 7 days of the event, we will not refund any portion of the fees paid, including the security deposit.

Postponement

If a client wishes to move a booking to another date, it is at Shutter Share's discretion whether this is a viable option. In most cases, a postponement can be arranged; however, if the postponement is deemed unviable, the booking will be subject to the Cancellation Policy.

Weather and emergency cancellation

If your event must be cancelled or rescheduled due to extreme weather, natural disaster, government emergency orders, or other circumstances that make the venue inaccessible or unsafe, you should contact us as soon as possible. Where you provide reasonable evidence of the emergency circumstances (such as severe weather warnings, evacuation orders, or venue closure notices), we will work with you in good faith to reschedule your booking to a mutually agreeable date at no penalty. If rescheduling is not possible, we will discuss appropriate refund options based on the circumstances.

Overtime

If your event runs late and requires extended access to the photo booth or other hire equipment, a $150 per hour overtime fee will be charged. It is at the discretion of Shutter Share if we provide overtime services. Keep in mind that your late-running event might ruin someone else's event.

If access is not granted to Shutter Share staff to the venue for conducting teardown at the scheduled time, hourly fees at a rate of $150 per hour will be charged until the time that access is granted.

Overtime charges are determined according to Shutter Share's records (including staff logs, timestamps, and venue access documentation). If you dispute an overtime charge, we will provide reasonable evidence of the circumstances and work with you in good faith to resolve the matter.

If it doesn't work out

If you have any concerns about our services, please tell us as soon as possible (and, where relevant, during your event) so we can try to resolve the issue. Where appropriate, we may offer a reasonable remedy such as rectifying the issue, providing a replacement service, rescheduling, or a partial refund.

Failure to deliver services

In the unlikely occurrence where Shutter Share cannot provide full services, liability will be limited to a total or partial refund of monies paid, dependent on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully. Shutter Share will not be liable for failing to provide the agreed-upon services due to any event beyond our reasonable control.

If equipment failure occurs during the event, it is your responsibility to contact Shutter Share about the issue immediately so we can try to rectify the issue promptly.

Shutter Share cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, act or fault on the part of any venue or venue staff, or is due to any negligence, act or fault on the part of you, your guests or any other person using a Shutter Share booth at your event.

Shutter Share reserves the right to pause or terminate the use of the photo booth at any time during the event if we consider that guests are behaving in a way that our staff believe to be dangerous to themselves or any persons, or potentially damaging to equipment. Shutter Share staff reserve the right to exclude a person or persons from the photo booth if they believe the person to be grossly intoxicated or behaving in an aggressive or abusive manner.

Force majeure

Shutter Share is not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather events, fire, flood, pandemic, government actions or restrictions, civil unrest, power outages, telecommunications failures, traffic incidents, road closures, vehicle breakdown, failures of third-party service providers (including gallery hosting providers such as Booth.Events), or any other force majeure event. In such circumstances, we will work with you to reschedule, provide an alternative delivery method where reasonably possible, or provide a refund where appropriate.

Illness or injury

In the unlikely event that we are unable to attend your event due to serious illness or injury, we will notify you as soon as reasonably possible. We will make reasonable efforts to arrange a suitable replacement service provider or reschedule your booking. If neither is possible, we will provide a full refund of all amounts paid. Our liability in such circumstances is limited to the refund of fees paid, and we will not be liable for any consequential losses or damages arising from the cancellation.

Equipment hire

All hired equipment will be removed by Shutter Share staff at the end of your hire period. However, you may keep any purchased keepsake addons, such as guestbooks, grid frames for pictures, and custom printed backdrops. Photo printouts from the event are also for your and your guests' keeping. Unused equipment, such as pens and unused pegs and stickers, must be returned to Shutter Share at the end of the event. For any items purchased as a keepsake (e.g. photo grid stand) that include powered components (e.g. batteries), there is no guarantee for the functioning of the powered component beyond the event. Certain add-ons, such as bollards, red carpet and marquees, are rented out and must be returned to Shutter Share at the end of the event.

Intellectual property and content

We own (or license) the rights in our equipment, software, templates, branding, and materials we create in providing the services. Subject to your payment of all fees, we grant you a personal, non-exclusive licence to use the photos, videos, GIFs and prints delivered from your event for personal and event-related purposes.

If you provide content for customisation (for example, logos, artwork, text, or designs for print templates), you represent that you have the right to use it and authorise us to use it for your booking.

Photo booth customisation

For customers requiring customisation of photo booth services (e.g. custom photo frames, custom printed backdrops, backgrounds, photo booth homescreen), you agree to provide customisation details at least 21 days in advance of the event.

For hires booked less than 21 days in advance, you will provide customisation details in the booking; Shutter Share will endeavour to fulfil these customisation requests, but reserves the right not to fulfil customisation requests at short notice.

Tangible props

Shutter Share provides customers the opportunity to opt-in to hiring tangible props for free. Where props are provided, we expect them to be returned at the end of the event. We understand accidents happen (and will not charge for accidental damage of props); however, we ask that you endeavour to keep our props safe, undamaged and hygienic, and return them at the end of your hire. We may charge for loss, theft, wilful damage, or excessive damage beyond reasonable wear. We provide examples of props in marketing images, but may change the props for hire from time to time depending on suppliers; you agree that you may not receive hire of the exact props displayed in marketing.

Use of artificial intelligence (AI)

Some services we provide (such as the AI glam filter and AI generated backgrounds) may not always satisfy everyone's expectations; you agree to this risk and will not hold Shutter Share responsible for undesired outputs from AI-related services. Refunds will not be provided for AI-generated outputs that you are dissatisfied with.

Service area

Our primary service area is the ACT and surrounding NSW regions. Travel fees may apply for events outside our standard service area. Any applicable travel fees will be included in your quote.

Shutter Share reserves the right to determine whether an event location is serviceable at our discretion. Event venues must be accessible via sealed roads or well-maintained gravel roads. We do not provide services to locations requiring 4WD access.

Indemnity

You agree to take responsibility for any reasonable claims, losses, damages, costs, or injuries that arise from your and your guest's use of our services, including where they result from misuse of the services, a breach of these terms, or a breach of the law or another person's rights. You agree to indemnify Shutter Share in relation to such claims worldwide. This clause is governed by the laws of Australia.

Dispute resolution

If there is a dispute about the services, you agree to contact us promptly and both parties will use reasonable efforts to resolve the issue in good faith. If the dispute cannot be resolved, either party may propose mediation before commencing court proceedings (except where urgent relief is required).

Limitation of liability

To the maximum extent permitted by law (and subject to the Australian Consumer Law), we exclude liability for indirect or consequential loss, loss of profit, or loss of opportunity. Our total liability arising out of or relating to your booking is limited to the fees paid by you for the booking.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Australian Consumer Law or other applicable laws that cannot be excluded, restricted or modified.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable, or if that is not possible, it will be severed from these Terms.

Entire agreement

These Terms, together with any quote, booking confirmation, and our Privacy Policy, constitute the entire agreement between you and Shutter Share relating to your booking and supersede all prior agreements, understandings, negotiations, and discussions (whether written or oral). We are not bound by any terms, conditions, or representations that are not expressly set out in these Terms or in a written booking confirmation from us.

Waiver

Our failure to enforce any provision of these Terms, or to exercise any right under these Terms, does not constitute a waiver of that provision or right. Any waiver must be in writing and signed by us to be effective. A waiver in one instance does not waive our rights in any other instance.

Acceptance of terms

By submitting a booking enquiry, signing a quote, making a payment (including a security deposit), or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you are booking on behalf of an organisation or another person, you represent that you have authority to bind that organisation or person to these Terms.

Website content and third-party listings

The content on our website — including blog posts, articles, guides, tips and other editorial material — is provided for general informational purposes only. It does not constitute professional advice (including but not limited to event planning, legal, financial or safety advice) and should not be relied upon as such. You should make your own enquiries and seek independent professional advice where appropriate before making decisions based on content published on our website.

Our website may also include listings, descriptions or links to third-party venues and businesses. These listings are provided for informational purposes only and do not constitute an endorsement, recommendation or guarantee by Shutter Share of any venue or business, its services, quality, safety or suitability for your event.

We make reasonable efforts to keep all website content and venue information accurate and up to date, but details (including availability, capacity, pricing, policies and facilities) may change without notice. You are responsible for independently researching and verifying any information, venue or business before making a booking or commitment. Shutter Share accepts no liability for any loss, damage or disappointment arising from your reliance on content or venue information published on our website.

Changes to terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services constitutes acceptance of the modified terms.
